ORAL ORDER. The parties cannot agree on how to proceed. Plaintiff seeks more time to litigate her case, see Dkt. 39 ; whereas Defendant plans to file a motion for summary judgment, arguing that Plaintiff's claims are barred by separate agreement, see Dkt. 38 . To avoid unnecessary costs and to be respectful of the parties' time, the Court will VACATE its May 4th Scheduling Order (Dkt. 26 ). In place of those deadlines, the Court ORDERS Defendant to file a motion for summary judgment on a single issue whether Plaintiff's claims are barred by the parties' divorce agreement and the state court's divorce decree on or before October 19, 2026. Plaintiff may file her response in opposition by November 2, 2026. If any of Plaintiff's claims survive Defendant's motion for summary judgment, the Court will enter an amended scheduling order that allows the parties to engage in discovery on Plaintiff's FLSA claims. Because the Court has vacated the existing scheduling order, it also DENIES Plaintiff's motion for extension of time (Dkt. 39 ) as moot. Entered by Senior Judge Norman K. Moon on October 5, 2026.
