SCHEDULING ORDER: On June 29, 2026, Magistrate Judge Marutollo issued a Report and Recommendation that recommended damages for certain alleged shell companies: Dynamic Pharmaceutical Supply Inc.; Foster Media Group Inc.; Foster Media Pharmaceutical Supply Corp.; J&M Medical Supply Inc.; JFK Wholesale & Retail Medical Supply Corp.; Merric Billing Inc.; New Line of Pharmaceutical, Inc.; Northwest Pharmaceutical & Medical Supply Inc.; Onliner Marketing Corp.; Park Avenue Pharmaceutical Corp.; Pharmaceutical Way, Inc.; Pure Gear Consulting Inc.; and Y&S Statistic Medical Supply Inc. (the "Shell Companies").
Upon further review, there appear to be mathematical errors in the proceeds calculation from Dkt. No. 252 -2 at 34 as to Dynamic Pharmaceuticals Supply Inc.; Foster Media Group Inc.; Foster Media Pharmaceutical Supply Corp.; J&M Medical Supply Inc.; JFK Wholesale &Retail Medical Supply Corp.; New Line of Pharmaceutical, Inc.; Onliner Marketing Corp.; Park Avenue Pharmaceutical Corp.; Pharmaceutical Way, Inc.; and Y&S Statistic Medical Supply Inc.
By October 2, 2026, Gilead shall file a supplemental memorandum of law in further support of its motion at 251 and 252 that corrects any damages errors regarding the Shell Companies. Gilead shall attach to its supplemental memorandum of law the following: (1) a declaration explaining the basis for each damages assertion made related to the Shell Companies; and (2) a spreadsheet of each respective damages calculation. Because the damages calculation are derived from adding the individual checks from banking records Dkt. Nos. 252 -42; 252 -43, the spreadsheet shall contain references to the individual check numbers for each calculation. Ordered by Magistrate Judge Joseph A. Marutollo on 9/29/2026. (JAM)
