Text Order ~Util - Terminate Motions
TEXT ORDER: This matter comes before the Court upon review of its docket. On June 18, 2026, this Court appointed the Honorable Jose L. Linares (ret.) as Special Master and ordered that the Court would decide whether to refer dispositive motions to the Special Master on a case-by-case basis after the completion of the briefing on those motions. (ECF Nos. 220 , 224 .) Plaintiffs/Counterclaim Defendants and Defendants/Counterclaim Plaintiffs have now completed the briefings on their Motions to Dismiss. (ECF Nos. 225 , 226 , 227 , 240 , 241 , 243 , 244 .) Upon review of the briefing and the orders issued by the Special Master, (see ECF Nos. 230 , 231 , 234 , 235 , 236 , 237 , 239 ), the Court will refer the Motions pending at ECF Nos. 225 and 227 to the Special Master, see Glover v. Wells Fargo Home Mortg., 629 F. App'x 331, 338 (3d Cir. 2015) ("Rule 53(a)(1)(C) authorizes appointment of a master to 'address pretrial and posttrial matters that cannot be effectively and timely addressed by an available district judge or magistrate judge of the district.'"); Mylan Pharms., Inc. v. Teva Pharms. Indus, Ltd., Civ. No. 21-13087, 2026 WL 982946, at *6 (D.N.J. Apr. 13, 2026) (noting court referred motion to dismiss to special master); CFTC v. Traders Glob. Grp. Inc., Civ. No. 23-11808, 2025 WL 2166272, at *1 (D.N.J. May 13, 2025) (noting court referred motion for dismissal sanctions to special master). The Special Master shall issue a Report and Recommendation on the Motions pending at ECF Nos. 225 and 227, and the parties may object to the Report and Recommendation consistent with Rule 53(f). The Clerk's Office is directed to administratively terminate the Motions pending at ECF Nos. 225 and 227 . So Ordered by Judge Georgette Castner on 9/11/2026. (jmh)
