PAPERLESS Minute Order for proceedings held before Magistrate Judge Marty Fulgueira Elfenbein: Discovery Status Conference held on 10/1/2026 via Zoom. Pro-Se Plaintiff William Lafont joined the Zoom late after attempts to reach him through phone calls and emails. Plaintiff represented that he does not have an attorney. The Court reminded him that the District Judge gave him 30 days to obtain a new attorney after his original attorney withdrew in August. Plaintiff was reminded that he needs to participate in discovery and respond to Defendant's emails and phone calls to discuss discovery and that he is running out of time to take discovery. The Court reminded Plaintiff that Defendant has filed a motion for sanctions against him for his failure to participate in discovery and that the Court entered an Order requiring that he respond to the motion for sanctions by October 7, 2026 and setting a hearing on October 8, 2026 at which Plaintiff must appear. Plaintiff provided his contact information (email and phone number) on the record. Plaintiff also advised that he is available for his deposition Monday through Friday after 8:30 am and before 2 pm. Defense counsel advised he will send notice of taking deposition via email to Plaintiff. The Court asked the Courtroom Deputy to email a copy of the motion for sanctions along with any exhibits and the Court's Order to Plaintiff's email address during the status conference, which was done. The Court advised Plaintiff and Defendant to meet and confer after the status conference so they can discuss the discovery matters prior to the hearing next week. Total time in court: 35 minutes.
