ORDER by Magistrate Judge John D. Early: ORDER REGARDING DEFENDANTS' MOTION TO DISMISS OR FOR A MORE DEFINITE STATEMENT [DKT. 30 ]. As an initial matter, the Joint Stipulation (Dkt. 31 ) is GRANTED and the Fourth, Fifth (as to Counts Four to Six only), Tenth, Eleventh, and Twelfth Claims in the FAC are dismissed without prejudice. For the foregoing reasons, Defendants' Motion (Dkt. 30 ) is GRANTED in part as to the Monell claim with leave to amend and DENIED in all other respects. If Plaintiffs elect to amend, Plaintiffs shall file any second amended complaint, solely amending the Monell allegations, within 14 days from the date of this Order. If Plaintiff files such a second amended complaint, Defendants are ordered to file their responsive pleading to such second amended complaint within 14 days of its filing.
