ORDER GRANTING 19 Third Motion to Continue Stay. Plaintiffs seek to extend the stay in this case for another 35 days. The Court knows from experience in handling ERISA cases of this sort that 30, or even 35, days is likely not enough time for the audit to be completed, for the parties to negotiate a potential settlement, and for the Plaintiff welfare funds to approve any settlement agreement. That has already proven true in this matter (see Docs. 15, 17, 19). Therefore, rather than continuing to extend the stay 30 days at a time, the Court sua sponte opts to extend the stay by 90 days, until September 24, 2026. If the parties require additional time to work on resolving this matter, they may file a motion no later than September 24, 2026, asking to extend the stay and advising the Court as to the status of the audit and settlement negotiations and the future handling of this case. If, on the other hand, it is clear that the parties will not be able to resolve the matter, Defendant shall file its Answer or other responsive pleading by September 24, 2026. If Defendant fails to do so, Plaintiffs are expected to promptly move for a clerk's entry of default. Signed by Magistrate Judge Mark A. Beatty on 7/2/2026.
