TEXT ORDER: The Court has reviewed Mr. Zemel's June 30, 2026 letter [D.E. 246], which contends that Defendant Citibank has not paid its portion of the deposition attendance fee for Plaintiff's expert as Federal Rule of Civil Procedure 26(b)(4)(E) requires. See Fed. R. Civ. P. 26(b)(4)(E) ("Unless manifst injustice would result, the court must require that the party seeking discovery: (i) pay the expert a reasonable fee for time spent in responding to discovery under Rule 26(b)(4)(A)...."). Defendant Citibank has not responded to the letter. On or before July 31, 2026, Citibank will either remit its portion of the expert fee to Plaintiff's counsel, or file a letter with the Court explaining its refusal to do so. This Order is filed in Civ. No. 19-8492 because Civ. No. 19-14127 was consolidated into Civ. No. 19-8492 by Order filed May 19, 2026. So Ordered by Magistrate Judge Michael A. Hammer on 7/8/2026.
