As of this writing, September 8, 2026 is the deadline for a response to the petition. With no response having been filed yet, the Supreme Court naturally has not yet acted on the petition. The parties will file another joint update about the status of plaintiff's certiorari petition. The joint update will be filed either 1) within two business days of a final decision from the Supreme Court concerning the petition; or 2) no later than November 13, 2026; whichever comes earlier.
