ORDER: The Parties contest the scope of Plaintiff's discovery demands, as well as subpoenas he seeks to enforce against non-parties. See ECF No. 58 , 62 , 65 . "Parties may obtain discovery regarding any non-privileged matter that is relevant to any party's claim or defense and proportional to the needs of the case[.]" Fed. R. Civ. P. 26(b)(1). Here, Plaintiff's far-reaching "institutional motive" theory that he seeks to develop is theoretical and not proportional to the needs of the case. Plaintiff fails to meet his burden of demonstrating how the disputed discovery is relevant to the elements of his actual claims. Thomsen v. Naphcare, Inc., 2020 WL 1441682, at *3 (D. Or. Mar. 24, 2020). Discovery in this matter is limited to topics concerning: (1) Plaintiff's alleged report of safety concerns; (2) Plaintiff's involvement in the March 9, 2024 Borderlands wind turbine blade incident; (3) the investigation of that incident and the resulting employment decision; (4) Plaintiff's subsequent employment with CES and Defendants' communications concerning Plaintiff; and (5) Defendants' communications with Plaintiff after his termination. Defendants' Motion for Protective Order, ECF No. 58 , is GRANTED in part. Defendants' Motion for Protective Order, ECF No. 62 , is GRANTED in part and DENIED in part; Plaintiff may issue third-party subpoenas that comply with the scope of discovery detailed above. Finally, Plaintiff's Motion to Compel (ECF No. 65 ) is GRANTED in part and DENIED in part. Defendants must respond Plaintiff's Requests for Production and First Set of Interrogatories pursuant to the scope of discovery identified in this Order. Ordered by Judge Michael J. McShane. (cp)
