ORDER GRANTING DEFENDANT CESAR RIVAS'S MOTION TO DISMISS 54 AND GRANTING IN PART AND DENYING IN PART DEFENDANTS COUNTY OF LOS ANGELES, LOS ANGELES COUNTY SHERIFF'S DEPARTMENT, AND ROBERT LUNA'S MOTION TO DISMISS 61 by Judge Stephen V. Wilson: For the foregoing reasons, Defendant Cesar Rivas's motion to dismiss is GRANTED and Defendants County of Los Angeles, Los Angeles County Sheriffs Department, and Robert Lunas motion to dismiss is GRANTED IN PART and DENIED IN PART. Plaintiffs are given 14 days to amend their complaint in accordance with this Order. If Plaintiffs fail to do so within the time allotted, their complaint will be dismissed with prejudice. Any amended complaint should also separate Plaintiffs § 1983 claims and theories of liability into different causes of action (i.e., municipal liability is an independent cause of action from a § 1983 claim for individual liability and must be alleged separately).
