MEMO ENDORSEMENT on re: 190 Letter filed by Bristol-Myers Squibb Company. ENDORSEMENT: UMB shall file a consolidated, amended complaint no later than October 16, 2026, that contains all live claims across UMB I and UMB II, with any amendment to Count IV of UMB II to clarify the scope of that claim as seeking relief that has nothing to do with the identity of the Trustee. Unless and until the Court orders otherwise, BMS shall defer any motion practice with respect to the amended Count IV until summary judgment (a briefing schedule for which the Court will set after the parties file their joint letter on September 24, 2026). If BMS believes that there is a basis (or need) to seek relief with respect to the amended Count IV sooner than summary judgment, it shall confer with UMB and file a letter motion seeking leave to seek earlier relief no later than two weeks after UMB files its consolidated, amended complaint. Absent such a letter motion, BMS shall answer the consolidated, amended complaint within thirty days; in the event that BMS files a letter motion seeking leave to file a motion with respect to the amended Count IV, it shall answer the consolidated, amended complaint within two weeks of the Court's ruling on the letter motion.
