ORDER DENYING WITHOUT PREJUDICE PLAINTIFF AND COUNTERDEFENDANT'S MOTION TO DISMISS [ECF No. 106 ] by Judge John W. Holcomb, For the foregoing reasons, the Court hereby ORDERS as follows: 1. HCC's instant Motion [ECF No. 106] is DENIED without prejudice. 2. The parties are DIRECTED forthwith to engage in an additional LR. 7-3 Conference of Counsel regarding the alleged infirmities in the Amended Counterclaim. 3. ETCO is DIRECTED to file an amended pleading, if at all, no later than August 21, 2026. If ETCO chooses to file an amended pleading, then it is also DIRECTED to file contemporaneously therewith a Notice of Revisions to First Amended Counterclaim that provides the Court with a redline version showing the amendments. 4. HCC and Starr Surplus Lines are DIRECTED to file their respective responses to ETCO's operative pleading no later than September 11, 2026. (es)
