MINUTE ORDER signed by Magistrate Judge Erica P. Grosjean on May 13, 2026: On May 12, 2026, Plaintiff's counsel filed a statement under Federal Rule of Civil Procedure 25(a)(1), stating that Plaintiff "Nathan Stowers passed away on March 20th, 2026." (ECF No. 18 ). The Court notes that Rule 25(a)(1) provides as follows: "If a party dies and the claim is not extinguished, the court may order substitution of the proper party. A motion for substitution may be made by any party or by the decedent's successor or representative. If the motion is not made within 90 days after service of a statement noting the death, the action by or against the decedent must be dismissed." Accordingly, IT IS ORDERED that any motion for substitution must be filed within 90 days after service of the statement or this case will be dismissed. Further, the June 17, 2026 scheduling conference is vacated, to be reset at a later date, if necessary. (ECF No. 14 ). (Text Only Entry) (Deputy Clerk FMN)
