It has come to the attention of the Court that the parties have failed to file a proposed discovery plan and scheduling order in accordance with United States District Court for the District of Nevada Local Rule 26-1. Further, neither party requested a stay of discovery and the filing of a motion to dismiss does not automatically stay discovery in federal court. Tradebay, LLC v. eBay, Inc., 278 F.R.D. 597 (D. Nev. 2011).
Accordingly, IT IS HEREBY ORDERED that the parties must file a joint proposed discovery plan and scheduling order or otherwise move or stipulate to stay discovery within 14 days of the date of this Order.

Traum in a Las Vegas Courtroom to be determined. Counsel will be notified of the courtroom location as soon as one is assigned.
