Stipulation and Order
STIPULATION AND ORDER STAYING CASE: NOW, THEREFORE, the Parties, by and through their respective counsel, hereby request that the Court enter an Order as follows: 1. The Postmedia Action is STAYED for all purposes. The Stay shall remain in place until no sooner than the earlier of two dates: (a) April 30, 2027 (approximately ten months from the date of this order) or (b) sixty days from the date of the Court's ruling on Google's motions for summary judgment on all claims asserted by Gannett and Associated Newspapers, MDL Action ECF No. 1357. 2. Any Party may file an application with the Court to lift the Stay upon the expirationof either date listed in paragraph 1. Prior to any such application to lift the Stay, the Parties shallmeet and confer regarding the application and a Case Management and Scheduling Order.3. The period between June 19, 2026 (the date the Postmedia Action was filed) andthe date of the lifting of the Stay shall not be included in calculating any time periods for thepurpose of the statute of limitations, laches, or any other time-based defense applicable to any claims or counterclaims any of the Parties may have against any of the other Parties. This provisiondoes not revive any claim that was already barred by a statute of limitations, laches, or other time-baseddefense prior to June 19, 2026.4. By entering into this Stipulation, Google does not waive any of the rights ordefenses it has to any of the claims, allegations, or issues raised in the Postmedia Action, includingthe right to move to dismiss any of Postmedia's claims as barred by a statute of limitations, laches, or other time-based defense. The Parties respectfully request the Court so order this Stipulation. IT IS HEREBY ORDERED that the foregoing Stipulation is approved and SO ORDERED. (Signed by Judge P.
