ORDER granting the 21 Plaintiffs' Motion for Leave to File First Amended Complaint, filed by Monica Lafayette, individually and on behalf of the Estate of Maressa Mays and on behalf of minor child Tari Mays and Marvin Hamilton, Sr., individually and on behalf of the Estate of Maressa Mays. The Motion for Leave was filed within 21 days of Defendants' Motions to Dismiss under Rule 12(b) and is, therefore, an amendment as of right under Fed. R. Civ. P. 15(a)(1)(B). The Clerk of Court is instructed to docket the [21-2] Proposed First Amended Complaint and Jury Demand ("First Amended Complaint") into the record of this matter, which will become Plaintiffs' operative complaint. Further, the Clerk of Court is instructed to TERMINATE the 16 Motion to Dismiss, filed by Defendants Sid J. Gautreaux, III, Sheriff of East Baton Rouge Parish, Warden Fontenot, Lt. Collins, Major McFarland, Capt. Miles, Capt. Leader, Sgt. Garment, Cpl. Alexander, Cpl. Chatman, Deputy Dunn, and Deputy Sawyer, and the 17 Motion to Dismiss, filed by Defendants Turn Key Health Clinics, LLC, Nurse Young, Nurse Wilson, Nurse Thomas, and Nurse Lang, by operation of Local Civil Rule 12 in light of the filing of Plaintiffs' amended complaint. The termination is without prejudice to any defendant refiling a Motion to Dismiss if grounds exist based on the allegations contained in Plaintiffs' First Amended Complaint.
