Order
Order [non-document] Based on a review of the parties' jurisdictional briefs (ECF Nos. 19 , 20 , 21 ), the Court finds that it has subject-matter jurisdiction over this action. Plaintiff Champion Moving LLC's sole member averred that he is a citizen and resident of Ohio, and Defendants have admitted that they are citizens and residents of North Carolina. There is thus complete diversity. With respect to the amount in controversy, "[i]t is well established that claims can be aggregated to satisfy the jurisdictional amount requirement." Klepper v. First Am. Bank, 916 F.2d 337, 341 (6th Cir. 1990). The Court finds that it is appropriate to aggregate Plaintiff's declaratory-judgment claim (seeking to declare the parties' rights in at least the amount Defendants paid and for which they have demanded a refund, which is approximately $50,000) with its claims for compensatory damages (seeking more than the amount of the chargeback, $32,602). See, e.g., Hardy v. Jim Walter Homes, Inc., No. 06-0687-WS-B, 2007 WL 1889896, *6 (S.D. Ala. June 28, 2007) ("[T]he amount in controversy in this action is properly computed as the sum of the value of the damages claims and the value of the declaratory judgment claim"); Persino v. UNUM Grp., No. 08 C 50004, 2008 WL 11625898, *2 (N.D. Ill. Aug. 22, 2008). The $75,000 amount-in-controversy requirement is therefore met. The Court will set this case for a case management conference by separate order. Magistrate Judge Jennifer Dowdell Armstrong on 6/25/2026. (K,L)
