TEXT ORDER entered by Judge Colleen R. Lawless on 7/14/2025: Before the Court is Defendant Menard Inc.'s Motion to Remand. (Doc. 5 ). On June 6, 2025, Defendant filed a Notice of Removal. The Parties have now stipulated that the maximum amount Plaintiff can recover is $74,900.00. (Doc. [5-1]). Generally, a post-removal stipulation by a plaintiff that the plaintiff will seek less than the jurisdictional amount does not destroy diversity jurisdiction. Chase v. Shop N Save Warehouse Foods, 110 F.3d 424, 429 (7th Cir. 1997). However, it is also true that the burden is on the removing party to show by a preponderance of the evidence that the amount in controversy exceeds the jurisdictional threshold. Oshana v. Coca-Cola Co., 472 F.3d 506, 511 (7th Cir. 2006). Because both Parties agree the amount in controversy is less than $75,000.00, this matter is REMANDED back to Sangamon County Circuit Court. (KLC)
