SCHEDULING ORDER: The Court ordered the parties to confer regarding a more appropriate response to Meritage's requests for production as well as the related dates for the close of discovery and the evidentiary hearing. As the Court noted at the last status conference, simply sending over 170,000 pages of unlabeled and uncategorized electronic documents to Meritage is not responsive to a request for production. The parties unsuccessfully attempted to confer and sought guidance from the Court. Attorneys for the remaining claimants (Dallas Glass and SSJ&H) and Meritage are ordered to meet in person at a neutral site and ordered to confer in good faith. This conferral must cover not only a reasonable plan for discovery, but the specific nature of the remaining claims at issue. This should allow the parties to formulate a reasonable discovery deadline and dates for the evidentiary hearing. The parties shall file a Joint Status Report within 14 days. Again, this conferral must be in person at a neutral site. Ordered by Judge Michael J. McShane. (cp)
