Defendant Donia Rassas has filed an Expedited Motion to Stay Discovery pending a ruling on her motion to dismiss. DE 51 . Since this Motion seeks a stay of discovery, the Motion is before Judge Artau. As an alternative relief to staying discovery, Defendant Rassas has requested an extension of time to respond to discovery requests. DE 57 . This Motion is before the Court, and thus the Motion must comply with this Court's Order Setting Discovery Procedures. This Court's Order Setting Discovery Procedures requires a party to confirm a discovery hearing date before filing a discovery motion. DE 36 . Since Defendant Rassas did not do so before filing the Alternative Motion for Extension of Time, the Court DENIES the Motion [DE 57 ] WITHOUT PREJUDICE for failing to comply with the Court's Order Setting Discovery Procedures.
