Minute Entry for proceedings held before Magistrate Judge Joseph A. Marutollo: A status conference was held on the record on October 15, 2026. Counsel for Plaintiff and Defendant Robert J. Kaufman appeared. Defendant Robert Kaufman did not appear. Discussion held. As discussed on the record, Plaintiff voluntarily withdrew its motion for default judgment as to Defendant Robert Kaufman at Dkt. No. 41 . In light of the settlement in principle as to Plaintiff's interpleader claim, Plaintiff shall file a stipulation of dismissal as to Defendant Robert J. Kaufman and a notice of discontinuance as to Defendant Robert Kaufman by November 13, 2026.
A virtual settlement conference is scheduled for October 23, 2026 at 2:00 p.m. before Magistrate Judge Joseph A. Marutollo with respect to Robert J. Kaufman's counterclaims. The parties shall submit ex parte settlement letters to Judge Marutollo's chambers via email (marutollo_chambers@nyed.uscourts.gov) by October 22, 2026 at 5:00 p.m. The ex parte settlement letters shall comply with Rule III of Judge Marutollo's Individual Practices and Rules. The parties are further directed to comply with Rule III of Judge Marutollo's Individual Practices and Rules regarding who must appear at the settlement conference.
