ORDER. Following today's videoconference with the parties, Plaintiff's counsel provided excerpts from Dr. Hurst's deposition in support of their argument that Demonstrative Aid #5 (a video animation) accurately reflects Dr. Hurst's opinion. The Court is not persuaded. The proposed animation shows internal pressure from upstream and downstream in the catheter converging at a point where the fracture occurred, clearly suggesting that an internal pressure buildup caused the fracture. The deposition testimony submitted this afternoon by Plaintiff's counsel, which was emailed to the Court and opposing counsel, continues to reflect Dr. Hurst's opinion that fracture occurs through "flexion fatigue." Although the testimony also mentions "traction" and "tension," these words are not explained and nothing is said about internal catheter pressures caused by distant catheter flexion as shown in the animation. The Court accordingly concludes that the proposed demonstrative aid is outside the opinions stated in Hurst's expert report, and the aid may not be shown to the jury.
