But defendant concedes that it is entitled to fees only if plaintiffs' claim was frivolous. Plaintiffs' interpretation of the CWA was novel, but there was no controlling authority on point, and plaintiffs supported their claim with nonfrivolous arguments based on the text and history of the statute.
