PAPERLESS ORDER denying 35 Plaintiff's Motion to Compel Mediation. I have reviewed the supplemental conferral certificate. (DE 18 ). Plaintiff's counsel assumed Defendants' opposition to the motion due to Defendants' lack of responsiveness to Plaintiff's scheduling requests. But Plaintiff did not confer regarding the filing of the Motion to Compel Mediation, and this is what is required. If a Defendant is non-responsive to conferral requests regarding the filing of a motion, the Local Rules contemplate such situations and set forth a procedure whereby the moving party can communicate this to the court. The answer is not to vaguely represent that conferral occurred when it did not. Accordingly, Plaintiff's motion is denied. The denial is without prejudice. Should Plaintiff choose to refile this motion, it must do so in strict compliance with all applicable rules of procedure. Signed by Judge Donald M. Middlebrooks on 8/21/2026. (kid)
