Order Dismissing Case
ORDER OF DISMISSAL. On May 24, 2022, Plaintiff filed a 24 Stipulation of Dismissal on behalf of the parties pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii). Under that provision, "the plaintiff may dismiss an action without a court order by filing... a stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ. P. 41(a)(1)(A)(ii) (emphasis added). Although the present 24 Stipulation includes only the Plaintiff's signature, it specifically represents that "plaintiff... and defendants... hereby stipulate that all claims and counterclaims in this action and this entire action should be dismissed with prejudice and without costs or attorney's fees awarded to either party." Doc. 24 , at 1 (emphasis in original). Despite the absence of Defendants' signatures, Plaintiff represents that Defendants have stipulated to dismissal; and there has been no objection by Defendants to this stipulation and thus no indication that the parties have not actually settled this case in full. Under these circumstances, pursuant to Federal Rule of Civil Procedure 41(a)(2), the Court hereby DISMISSES the case WITH PREJUDICE and without costs or attorneys' fees to any party, pursuant to the parties' stipulated agreement -- "on terms the court considers proper."
