MEMORANDUM Opinion and Order signed by the Honorable Edmond E. Chang. For the reasons stated in the Opinion, the Court grants in part and denies in part the Defendants' motions to dismiss, R. 77; R. 78; R. 104. The following counts remain: Count 2 for damages under the Rehabilitation Act, as to St. Anthony Hospital, Dr. Majed Dalloul, Dr. Ralph Menezes, Tiffany L. Dean, Dr. Bikram Sharma, and Meredith Castaneda; Count 4 asserting negligent medical care, as to all individual Defendants; Coun t 5 asserting respondeat superior, as to Rush Oak Park Hospital and St. Anthony Hospital; Count 6 asserting negligent supervision, as to Rush Oak Park Hospital and St. Anthony Hospital; Count 7 asserting false imprisonment, as to all Defendants; Coun t 8 asserting battery, as to all Defendants; Count 9 asserting intentional infliction of emotional distress, as to all individual Defendants; and Count 10 asserting negligent infliction of emotional distress, as to all Defendants. The remaining claim s are dismissed. On or before 08/19/2026, the Plaintiff may amend her pleadings if she can do so consistent with Civil Rule 11(b). The Plaintiff may attempt to re-allege all of the dismissed claims except her theory of injunctive relief, which is dis missed without leave to amend. In the meantime, the case will proceed on the remaining claims. The Defendants shall answer the Second Amended Complaint on or before 08/26/2026. Rule 26(a)(1) disclosures are due by 08/19/2026. The first round of writ- ten discovery requests must be issued no later 09/02/2026. Fact discovery (including with treating health-care providers) shall close on 03/29/2026. The Rule 16(b) deadline to add parties or to amend pleadings is 11/23/2026. No early summary judgment motion may be filed before the close of discovery without leave of Court. Discovery supervision is referred to the magistrate judge (including the authority to adjust all deadlines). The tracking status hearing of 08/21/2026 for Judge Chang is reset to 10/23/2026 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). Order on Motion for Extension of Time to File Response/Reply ~Util - Set/Reset Deadlines
TEXT ORDER entered by Judge Sara Darrow on August 5, 2026. Plaintiff's 115 2nd Emergency Verified Motion for Extension of Time to File Responses (Oppositions) to Defendants' Motion to Dismiss is GRANTED IN PART. Plaintiff has previously been granted extensions of time to respond to Defendants Wendy Hughes and Joe Rossmiller's 97 motion for summary judgment, Defendant Megan Clemons's 101 motion to dismiss, and the 98 motion for sanctions. See July 1, 2026, Text Order. Plaintiff now requests "an extension through Labor Day for a status on which [of those] motions she is responding to" and states that she "will probably file 2/3rds of them." 115 2nd Mot. Extension 2. She also, however, requests extensions through September 7, 2026, to respond to the 101 motion to dismiss and through September 14, 2026, to respond to the 97 98 motions. Id. at 3. The motion is GRANTED to the extent that, due to Plaintiffs health and housing challenges, Plaintiff has until September 7, 2026, to respond to the 101 motion to dismiss and until September 14, 2026, to respond to the 97 motion for summary judgment and the 98 motion for sanctions. At that time, Plaintiff will have had approximately four months to respond to these three motions. No further extensions of time will be granted. If no responses are filed by the deadlines, the Court will consider the motions unopposed and proceed to rule on them. The Clerk is directed to email a copy of this order to Plaintiff. (SB)
