Minute entry for STATUS CONFERENCE before Judge Charles Eskridge on September 1, 2026. Defendants represented by counsel. Plaintiffs not represented, with lead attorney, David Daniel, not present. It was noted that the hearing was noticed and docketed. Defendants also stated that they had advised Plaintiffs counsel about the hearing by email, messages, and voicemail, who did not respond. It was noted on the record that it was a clear day with no weather or major traffic problems causing delays. The Court addressed the decision of the Fifth Circuit in Larkins v SDP Manufacturing Inc, 179 F4th 304 (5th Cir 2026), holding that the then-existing record on summary judgment precluded entry of judgment on the issue of diligence. See Dkt 74 at 14. Upon oral request by Defendants, permission was GRANTED to bring (i) a motion for sanctions for failure to appear, and (ii) a motion to bifurcate discovery as to the issue of the statute of limitations. Such motions should be brought within fourteen days, absent extension requested and received. Plaintiff will be permitted to file responses under normal briefing deadlines. Defendants were ADVISED that if, through discovery into the statute of limitation, they become aware of violations of Rule 11, they may file a motion in that regard. See Thomas v United Airlines Inc, 2023 WL 5690084 (SD Tex). The Court addressed the potential for settlement. Defendants advised that counsel for Plaintiff has not engaged in discussion regarding resolution except as obligated under Rule 26(f).
