Order on Motion for Contempt
PAPERLESS ORDER: Plaintiff has filed a Notice of Filing, to which it attached Defendant's Suggestion of Bankruptcy sent to him by Defendant's counsel. [DE 217]. Because Defendant has filed a Chapter 13 Bankruptcy Proceeding, the in-person hearing previously scheduled for March 27, 2024, is hereby CANCELLED in light of the automatic stay. Further, Plaintiff's Motion for Contempt Against Defendant Scott Gold for Failure to Comply with the Court's Order to Complete Fact Information Sheet [DE 197] is hereby DENIED without prejudice to Plaintiff's ability to re-file the motion at an appropriate juncture, if necessary. The Court notes that Plaintiff's counsel filed the Notice of Filing which attached the Suggestion of Bankruptcy sent to him by Defendant's counsel, Shaun T. Plymale. It appears that Mr. Plymale prepared the Suggestion of Bankruptcy and put this federal case's caption at the top of the Suggestion of Bankruptcy. Yet, for some reason, Mr. Plymale has not filed a notice of appearance or any other document in this case. In light of his signing of the Suggestion of Bankruptcy now filed in this case, Shaun T. Plymale and any other attorneys from Treasure Coast Legal who represent Defendant in this matter shall promptly file notices of appearance in this case. Finally, the parties shall file a joint status report regarding the bankruptcy proceeding within 60 days of this Order and every 60 days thereafter, and they shall promptly notify the Court when the bankruptcy proceeding is closed or terminated.
