ORDER GRANTING MOTION TO RESOLVE FUNDAMENTAL CONFLICT by Judge Otis D. Wright, II: The Court finds that the Complaint does not plead any RICO claim for collection of an unlawful debt as defined in § 1961(6). Additionally, the Court previously found that the Complaint does not contain any claims requiring the interpretation or performance of the MCA Agreementthat ruling remains in full force and effect. The Court DENIES Defendants' request to strike portions of the proposed pretrial conference orders. Instead, the Court ORDERS that Plaintiffs shall not include in the amended pretrial conference documents due in November any RICO claims premised on the collection of an unlawful debt or any claims requiring the interpretation or performance of the MCA Agreement. The parties are directed to scrupulously adhere to the Courts reasoning and rulings herein or be subject to sanctions. (lc)

As noted in Section III.A.2 of Judge Robinson's Standing Order for Civil Cases, "[a]n opposing party's failure timely to file an opposition to any motion may be construed as consent to the granting of the motion pursuant to Civil Local Rule 7.1(f)(3)(c)."
