AMENDED ORDER: The August 13, 2024 Order 63 is VACATED as to the dismissal of Count 1 ONLY. Defendants' Amended Motion to Dismiss Amended Complaint 18 is GRANTED. Count 1 of the Amended Complaint is dismissed without prejudice for lack of jurisdiction. Counts 2 through 9 are dismissed with prejudice for failure to state a claim. Plaintiff's motions to amend (Docs. 20, 21, 28, 37, 40, 54) are DENIED as Plaintiff has already been afforded one opportunity to amend his complaint as a matter of right pursuant to Fed. R. Civ. P. 15 and because the Court finds further amendment would be futile. The Clerk is directed to terminate any pending motions and deadlines and close this case.
