ORDER granting 4 Motion to Dismiss for Failure to State a Claim; granting 10 Motion to Strike 4 MOTION to Dismiss for Failure to State a Claim , 10 MOTION to Strike and/or MOTION to Vacate Default Judgment ; granting 10 Motion to Vacate IT IS HEREBY ORDERED that 1. The motion to strike and/or vacate default judgement, (doc. 10), filed by Defendant Verizon Pension Plan for Associates is GRANTED 2. The default judgement entered by the Wayne County Court of Common Pleas is set aside; 3. Defendant's motion to dismiss, (doc. 4), is GRANTED; 4. Plaintiff's complaint is DISMISSED without prejudice to the plaintiff filing an amended complaint that conforms with the causes of action set forth in the Employee Retirement Income Security Act of 1974; 5. This case is STAYED for the plaintiff to exhaust the claim and appeals process delineated in the documents governing the Verizon Pension Plan for Associates; 6. The Clerk of Court is directed to administratively close this case; and 7. The parties shall provide a joint status report every ninety (90) days regarding exhaustion of plan remedies.
