ORDER granting 233 Motion to Take Deposition ; granting 236 Motion to Withdraw as Attorney.
The Court is in receipt of attorney Brandon Sample and Brandon Sample PLC's Unopposed Motion to Withdraw Attorney Appearance. (Doc. No. 236.) Under District of Minnesota Local Rule 83.7(c), withdrawal of counsel in the absence of substitute counsel may only be allowed upon a motion and a showing of "good cause." D. Minn. Loc. R. 83.7(c). For good cause shown, the motion is GRANTED, and attorney Brandon Sample and Brandon Sample PLC are hereby withdrawn as counsel of record for Defendants Huy Ngoc Nguyen, D.C., Health Care Chiropractic Clinic, Inc., and Accident Recovery Chiropractic Clinic, P.A. In addition, attorney Daniel L. Gerdts, is also hereby withdrawn as counsel of record for these Defendants because as local counsel, his participation in the case was contingent on Mr. Sample's continued representation. (See Doc. No. 218.)
The Court is in receipt of Plaintiffs's Second Motion for Leave to Take Deposition of Defendant Huy Nguyen (Doc. No. 233). This motion is GRANTED. However, Plaintiffs must wait 21 days from the date of this order to notice the deposition, to allow Defendant Huy Nguyen to obtain new counsel. If counsel is not obtained by the date of the noticed deposition, Defendant Huy Nguyen must participate in the deposition pro se without counsel. Signed by Magistrate Judge Becky R.
