ORDER - During the five-day court trial held in this case, the Court ordered that a portion of the trial testimony heard on July 13, 2026, of Kimberly Holmes, Oregon Executive Director for the Circular Action Alliance ("CAA") be sealed to protect potential trade secrets belonging to CAA. The Court has since received a letter from Erica A. Clausen, P.C., outside counsel for CAA, dated July 30, 2026. In that letter, Ms. Clausen informed the Court that "CAA has reviewed the sealed portion of the rough transcript from July 13, 2026, relating to Ms. Holmes's testimony and "[b]ased on that review, CAA concludes that Ms. Holmes's sealed trial testimony does not need to remain sealed." Accordingly, the Court hereby UNSEALS the previously sealed portion of Ms. Holmes's trial testimony from July 13, 2026, and it shall become part of the ordinary, unsealed transcript of the trial testimony from that day. Trial Exhibits 5, 12, 13, and 42 shall remain under seal, as previously directed. See ECF 193 . Ordered by Judge Michael H. Simon. (mja)
