STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned counsel for Plaintiffs-Counterclaim Defendants Energo Power & Gas LLC and Energo PG Holdings LLC ("Energo"), and Defendant-Counterclaim Plaintiff Constellation Energy Generation, LLC ("Constellation"), that, pursuant to Federal Rule of Civil Procedure 4l(a)(l)(a)(ii), Energo, through their undersigned counsel, and Constellation, through its undersigned counsel, hereby stipulate to the dismissal with prejudice of both the claims asserted by Energo against Constellation in the Amended Complaint and the claims asserted by Constellation against Energo in the Counterclaim, with each party to bear its own costs and attorneys' fees.
