NOTICE : The Plaintiffs are correct. Pursuant to Rule 55(a) of the Federal Rules of Civil Procedure, the Clerk was required to enter the default against the Defendants. Because this Court lost jurisdiction over this case once the Clerk refused to enter the Entry of Default, any orders entered thereafter (including the July 2, 2026 Dismissal Order (Dkt 12) are deemed VOID and a NULLITY. There is no statute of limitations for Fraud Upon the Court and Extrinsic Fraud. Therefore, the Plaintiffs' claims cannot be barred. MINUTE ORDER. In light of the Court's 12 Order and July 2, 2026 Minute Order dismissing this case with prejudice, it is ORDERED that the plaintiffs' July 4, 2026 Notice is STRICKEN. To the extent that the plaintiffs seek to challenge the Court's orders, they may appeal the Court's decision to the Court of Appeals or move to reopen this case under Federal Rule of Civil Procedure 59(e) and/or Federal Rule of Civil Procedure 60(b).
