MINUTES (IN CHAMBERS) ORDER DENYING DEFENDANTS' REQUESTS FOR JUDICIAL NOTICE (DKTS. [8-2] and [11-1]); AND GRANTING IN PART AND DENYING IN PART DEFENDANTS' MOTION TO DISMISS (DKT. 8 ) by Judge Michelle Williams Court Granting in Part and Denying in Part 8 MOTION to Dismiss Case: For the foregoing reasons, the Court ORDERS as follows: 1. Defendants' Requests for Judicial Notice (Dkts. No. 8-2 and 11-1) are DENIED. 2. Defendants' Motion to Dismiss (Dkt. No. 8) is GRANTED IN PART AND DENIED IN PART as follows: (see document for further details). 3. Within twenty-one (21) days, Plaintiffs may file an amended Complaint or a notice of dismissal. As there is at least one surviving claim for waste against Defendant Golden State Supply, LLC, the failure to timely file either document indicates to the Court that Plaintiff intends to continue litigation based on this claim. 4. The July 10, 2026 hearing is VACATED. (bm)
