MINUTE entry before the Honorable Heather K. McShain: Pending before the Court are the parties' separate status reports [49, 50] filed in the wake of the parties' failed private mediation session in late May. The parties are admonished that they are not permitted to file separate status reports in response to a court order requesting a joint status report, and plaintiff is admonished for filing a status report that does not contain any information about the progress of discovery despite the Court's request for this information [44, 47, 48]. Plaintiff reports that she intends to file a motion to compel discovery and a motion for sanctions based on defendant's alleged bad-faith participation in mediation. Given the slow pace of discovery in this case and the lack of meaningful updates on discovery in the parties' previous status reports, see [39, 41, 44], the Court is concerned that plaintiff's first step after the failed mediation is to file motions to compel and for sanctions. Before filing any discovery motion in this case, the parties must review and comply with Judge McShain's standing order on discovery motions (available on the Court's website at www.ilnd.uscourts.gov by selecting the link for Magistrate Judge McShain and then the link for "Discovery Motion Requirements"). Any discovery motion that does not comply with the Court's standing order will be summarily denied. Although it is unclear whether plaintiff intends to present her motion for sanctions to the undersigned or the District Judge, the Court orders that plaintiff may not file this motion until she meets and confers with defendant about the basis of this motion in good faith and in compliance with the undersigned's standing order on discovery motions. Regarding defendant's plans for moving to consolidate this case with three other cases in this District in which it is a defendant, any motion to consolidate should be presented to the District Judge as issues of consolidation are beyond the scope of the referral of this case to the undersigned. A joint status report is due on 07/15/2024 to update the Court on: (a) the progress of fact discovery; (b) whether the parties anticipate expert discovery; (c) the status of settlement discussions, if any; and (d) any other issues the parties wish to raise with the Court.
