Judge Richard G. Stearns: ELECTRONIC ORDER entered granting 1975 Motion to Amend. The Joint Motion to Further Amend Schedule Seven is ALLOWED. The following sentence in footnote 48 of Schedule Seven (as amended May 13, 2026): If the MWRA has not received comments from EPA and MassDEP by August 31, 2026 on the Draft Updated CSO Control Plan, the January 31, 2027 deadline, or later deadline if approved by MassDEP, for the MWRAs submission of the Final Updated CSO Control Plan shall be extended by a time period equivalent to the time period between August 31, 2026 and the receipt of comments from EPA and/or MassDEP.is replaced with the following: If the MWRA has not received comments from EPA and MassDEP on the Draft Updated CSO Control Plan at least five months before the deadline approved by MassDEP for submission of the Final Updated CSO Control Plan (the Deadline), the Deadline shall be extended to five months after MWRAs receipt of such comments. However, if MWRA has received comments from EPA and MassDEP on the Draft Updated CSO Control Plan at least five months before the Deadline, the Deadline shall remain unchanged.(MZ)
