STIPULATION AND ORDER OF VOLUNTARY DISMISSAL: IT IS HEREBY STIPULATED and AGREED by and between the undersigned counsel for the parties herein that, this case having settled between Plaintiff and Defendant National Railroad Passenger Corp. (Amtrak) and between Plaintiff and MSG Arena, LLC, pursuant to Fed. R. of Civ. P. 4l(a), all of Plaintiff's claims that are, or could have been, asserted in the above captioned action be and are hereby dismissed with prejudice as to the sole remaining Defendants NATIONAL RAILROAD PASSENGER CORP. (AMTRAK) and MSG ARENA, LLC, and each party to this stipulation shall bear its own costs, expenses, and attorneys' fees as incurred against one another in connection with this action. IT IS FURTHER STIPULATED AND AGREED that pursuant to Fed. R. Civ. P. 4l(c), all of Defendants NATIONAL RAILROAD PASSENGER CORP.'s (Amtrak's) and MSG ARENA, LLC's crossclaims asserted against each other in the above-captioned action are voluntarily dismissed with prejudice and without payments, attorneys' fees, costs, disbursements, or expenses to any of these parties against the other.IT IS FURTHER STIPULATED AND AGREED that signatures by email, facsimile, scans, and/or photocopy shall be accepted with the same force and effect as originals. All open motions are terminated. So Ordered MSG Arena, LLC, MSG Arena, LLC, MSG Arena, LLC, MSG Arena, LLC, National Railroad Passenger Corp. (Amtrak), National Railroad Passenger Corp. STIPULATION OF DISCONTINUANCE: IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned the attorneys of record in the above entitled action that whereas no party herein is an infant or incompetent person as of the date of this Stipulation, that the above entitled action, and all claims and cross-claims, are hereby withdrawn and discontinued with prejudice, with respect to defendants METROPOLITAN TRANSPORTATION AUTHORITY and NEW YORK CITY TRANSIT AUTHORITY only. IT IS HEREBY STIPULATED, AGREED AND CONSENTED TO that this Stipulation may be executed in any number of counterparts, all of which taken together, shall constitute one and the same instrument; that facsimile signatures to this Stipulation may be treated as original signatures; and that this Stipulation may be filed without further notice with the clerk of the Court.
