ORDER Following this Court's September 21, 2026 order, counsel for the Plaintiffs submitted an email exchange with Timothy J. Beall's mother confirming that Mr. Beall is likely to remain incarcerated in Massachusetts until at least October 13, 2026. As jury selection is scheduled in this case for October 7, 2026 and trial is scheduled to commence directly after jury selection and continue until October 13, 2026, it is apparent that the Court may not hold a jury trial while the Defendant is incarcerated and furthermore, Mr. Beall's incarceration will affect his ability to adequately prepare for trial, even if he were released early. Accordingly, the Court ORDERS the October trial continued and all trial deadlines vacated. As soon as possible and in any event upon his release from custody in Massachusetts, the Court ORDERS Timothy J.
