ENDORSED ORDER. Upon review, the court advises Plaintiff and Defendant Experian Information Solutions, Inc. that their joint stipulation of dismissal under Rule 41(a)(1)(A) is ineffective. (See Dkt. 107.) To begin, the stipulation does not satisfy Rule 41(a)(1)(A)(ii), as Plaintiff and Experian Information Solutions are the only parties to have signed the stipulation. See Fed. R. Civ. P. 41(a)(1)(A)(ii) (permitting a plaintiff to dismiss its claim without a court order by filing "a stipulation of dismissal signed by all parties who have appeared"). The stipulation is also ineffective under Rule 41(a)(1)(A)(i), as Experian Information Solutions previously responded to the complaint. (See Dkt. 20.) See Fed. R. Civ. P. 41(a)(1)(A)(i) (permitting a plaintiff to voluntarily dismiss its claim without a court order "before the opposing party serves either an answer or a motion for summary judgment").
