ORDER signed by the Honorable Andrea R. Wood on 3/31/2024: Defendant Johnson's Rule 62(d) motion to stay enforcement of judgment with respect to the Independent Fiduciary's fees and work 312 is denied as moot. The Independent Fiduciary may proceed with distributions to all Plan participants with the exception of Defendant Sherrod. The Independent Fiduciary is directed to holdback any distributions to Defendant Sherrod from her Plan account until further order of the Court, to account for payment of the Independent Fiduciary's fees and expenses and any sanctions imposed in connection with the contempt proceeding, among other things. The Independent Fiduciary's motion for additional fees 320 is granted. Specifically, the Court grants the Independent Fiduciary's request for immediate payment of $12,000 from Defendant Sherrod's Plan account for its fees and expenses. Further, the Final Judgment and Order Granting Injunctive and Equitable Relief is modified to increase the Independent Fiduciary's maximum award of compensation for fees and expenses reasonably and necessarily incurred to perform its duties to $40,000.
