ORDER GRANTING 56 Motion to Deposit Funds. ORDERED that, within fourteen (14) days of the date of this Order, Ameriprise shall deposit into the registry of the Court the disputed escrow funds in the amount of $582,942.00, together with any interest accrued thereon, by cashiers check payable to Clerk, U.S. District Court. It is further, ORDERED that, as soon as practicable after receipt, the Clerk of the Court shall deposit the funds in the Disputed Ownership Fund of the Court Registry Investment System (CRIS), where the funds shall remain pending further order of the Court. It is further, ORDERED that Ameriprise shall file a notice confirming completion of the deposit within three (3) business days after the Clerk of the Court confirms receipt of the escrow funds. The Court RESERVES RULING on Ameriprises requests to restrain separate proceedings affecting the escrow funds, discharge Ameriprise from further liability as stakeholder, and establish procedures for adjudicating Defendants competing claims to the funds pending receipt of notice that the required deposit has been completed.
