ORDER AND JUDGMENT by Judge Terry J. Hatter, Jr. Granting in part and denying in part 32 for Summary Judgment; denying 42 MOTION for Leave to File: It is Ordered that Plaintiff's motion for leave to file a surreply be, and hereby is, Denied. It is further Ordered that Defendants' motion for summary judgment be, and hereby is, Granted only as to Plaintiff's claims for violation of 47 U.S.C. Sec. 605 and 47 U.S.C Sec. 533. It is further Ordered, sua sponte, that Plaintiff's claim for unfair competition be, and hereby is, dismissed without prejudice, for lack of equitable jurisdiction. It is further Ordered that, because the Court declines to exercise supplemental jurisdiction over Plaintiff's sole remaining claim for conversion, the conversion claim be, and hereby is Dismissed for lack of jurisdiction.
