MEMO ENDORSEMENT on re: 32 Letter filed by Victor Manuel Castillo Jr,ENDORSEMENT: Application GRANTED. The motion to dismiss in this matter has been pending for nearly six months. ECF No. 21. This is Plaintiffs fifth letter for an extension of time to oppose the motion. ECF Nos. 24, 26, 28, 30, 32. Plaintiff has repeatedly violated the Court's individual rule 2(e)(ii), which requires that all extensions of time shall be made as early as possible, and at lease two business days before the deadline or scheduled appearance. ECF Nos. 29 & 31. Despite explicit warnings, Plaintiff now brings this motion for an extension on the day it is due. Further, the Court's last order expressly stated that "[n]o further requests for extension of time shall be granted absent a showing of extraordinary circumstances." While the Court is sympathetic to Plaintiffs representations that Plaintiffs counsel has a heavy workload and is under staffed, Plaintiff has had six months to prioritize this motion. This does not, therefore, amount to an "extraordinary circumstance." However, because Plaintiff only requests a brief extension, to July 13, 2026, and because Defendant consents, the Court is willing to accept a belated filing. Accordingly, Plaintiff shall file any opposition to the motion to dismiss by July 13, 2026. Defendant shall file any reply by July 20, 2026. Should Plaintiff fail to meet this deadline, the Court will consider the motion fully briefed and will adjudicate accordingly. SO ORDERED.
