ORDER GRANTING IN PART AND DENYING IN PART DEFENDANT MERCEDES-BENZ USA, LLC'S MOTION FOR SUMMARY JUDGMENT [DKT. 90]; AND DENYING IN PART DEFENDANT'S MOTION FOR LEAVE TO FILE NOTICE OF SUPPLEMENTAL AUTHORITY [DKT. 143] by Judge Fernando L. Aenlle-Rocha: For the aforementioned reasons, the court GRANTS in part the Motion (Dkt. 90 ) and ENTERS summary judgment in Defendant's favor as to Plaintiff Roberson's claim. The Motion is otherwise DENIED. Defendant's Motion for Leave to File Notice of Supplemental Authority (Dkt. 143) is DENIED with respect to the subject Motion, as not relevant to the court's ruling. The court AMENDS in part the Order Regarding Joint Requests for Decision (Dkt. 142 ), and INFORMS the parties that it will render a ruling on Plaintiffs' Motion for Class Certification (Dkt. 84) by September 30, 2026.
