ORDER: The parties were directed to file a stipulation of dismissal by June 3, 2026 but failed to do so. The Court directs the Clerk to administratively close this case. If the parties are unable to consummate a final settlement agreement, they may file a motion to reopen. If neither side files a motion to reopen by July 23, 2026, the claims will be deemed to be dismissed without prejudice. See Fed. R. Civ. P. 41(a)(2); Morris v. City of Hobart, 39 F.3d 1105, 1109–10 (10th Cir. 1994); Cantrell v. Int'l Bhd. of Elec. Workers, AFL-CIO, Loc. 2021, 69 F.3d 456, 457 n.1 (10th Cir. 1995). And at that point, the Court will no longer have jurisdiction to enforce any settlement agreement. Papotto v. Hartford Life & Acc. Ins. Co., 731 F.3d 265, 275 (3d Cir. 2013) ("Dismissals end all proceedings, at which time the district court relinquishes any jurisdiction over the matter.") (citing Green Tree Fin. Corp. v. Randolph, 531 U.S. 79, 86 (2000)). If the parties wish the Court to retain jurisdiction to enforce any settlement agreement, they must file a joint motion asking the Court to do so, by the deadline to move to reopen, file a public copy of the settlement agreement on the docket, and explain why the Court should retain jurisdiction to enforce.
