STIPULATION AND ORDER OF SETTLEMENT AND DISCONTINUANCE with prejudice...., Scott Wallach (individually), Joseph Schaller (individually) and Matthew Velasco (individually) terminated. IT IS HEREBY STIPULATED AND AGREED by and between Plaintiff and the City Defendants and their respective counsel that the action is settled in the following terms: Plaintiff withdraws all claims against Defendants Velasco, Schaller and Wallach. The city shall pay and Plaintiff has agreed to accept, in full and final settlement in this action, the total sum of FIFTY FIVE THOUSAND DOLLARS and NO CENTS. ($55,000.00) (the Settlement amount) by check to Timko & Moses, LLP upon the execution of this Stipulation and attached General Releases and the dismissal of this action with prejudice against all defendants. The Settlement shall be distributed as determined, pursuant to the retainer agreement between Plaintiff and his attorneys. As further stated in this order, this stipulation embodies the entire understanding between the parties with respect to the subject matter hereof and no changes, waiver or modification of this Stipulation may be made without written consent of an authorized representative of each party hereto.
