Stat. § 480.065, subd. 3, the following question is CERTIFIED to the Supreme Court of the State of Minnesota: Is a restrictive covenant unenforceable as against public policy when the restrictive covenant bars a fiduciary (such as a doctor, lawyer, or financial advisor) from continuing to provide services to a beneficiary (such as a patient or client) for a period of time after the fiduciary leaves a practice, firm, or other employer, even when the fiduciary has not solicited the beneficiary or otherwise influenced the beneficiary's decision to continue to seek the fiduciarys services? The Clerk of Court is directed to forward a copy of this Order of Certification to the Minnesota Supreme Court and to furnish to the Minnesota Supreme Court such part of the record of this case that it may request.
