DOCKET TEXT ORDER VACATING SETTLEMENT CONFERENCE: This case was referred to Magistrate Judge Daphne A. Oberg for a settlement conference. (Doc. No. 26 .) Per the Settlement Conference Order, (Doc. No. 28 ), the parties submitted a joint case status report and separate confidential settlement statements. The undersigned then held pre-conference meetings with each partyfollowed by additional settlement-related correspondence. As the settlement briefs, candid discussions, and subsequent correspondence made clear, settlement is infeasible at this time. The parties' relative positions are too disparate. Therefore, the settlement conference scheduled for October 7, 2026, is VACATED. The undersigned asks that the settlement referral be withdrawn. However, if the parties' positions materially change as the case proceeds, such that settlement may be feasible, the parties are invited to renew their motion for a settlement conference.
